This Acceptable Use Policy (this "AUP") describes prohibited uses of the software-as-a-service offerings, websites, APIs, and related products made available by Flannel Technologies, Inc. ("Flannel," "we," "us," or "our") (collectively, the "Services"). This AUP supplements, and is incorporated by reference into, the Terms of Service or other agreement between Flannel and the customer or organization that subscribes to the Services (the "Agreement"), and applies to all customers, end users, and other persons who access or use the Services (each, a "User").
Users are responsible for their own conduct and for the conduct of anyone who accesses the Services through their account. Violating this AUP may result in suspension or termination of access to the Services, as described in Section 8 below.
Capitalized terms not defined in this AUP have the meanings given to them in the Agreement. We may update this AUP from time to time as described in Section 9.
1. GENERAL PRINCIPLES
You agree to use the Services lawfully, responsibly, and only for purposes authorized by Flannel and the Agreement. You shall not use the Services in a manner that:
- violates any applicable law or regulation;
- infringes, misappropriates, or otherwise violates the intellectual property, privacy, publicity, contractual, or other rights of any person or entity;
- breaches any duty of confidentiality you owe to a third party; or
- is otherwise prohibited by the Agreement, the Documentation, or this AUP.
2. PROHIBITED CONTENT
You shall not use the Services to upload, store, transmit, generate, distribute, publish, or otherwise process content that:
- is unlawful, defamatory, libelous, obscene, harassing, threatening, hateful, or otherwise objectionable;
- depicts, promotes, or facilitates child sexual abuse material ("CSAM") or any sexual exploitation of minors;
- incites, glorifies, or facilitates violence, terrorism, self-harm, or suicide;
- promotes or facilitates discrimination, harassment, or bullying based on race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, age, veteran status, or any other characteristic protected by applicable law;
- includes non-public personal information of any individual without lawful basis and appropriate consents;
- includes sensitive personal information (such as financial account numbers, government identifiers, biometric data, health data, or precise geolocation) for which the Services have not been specifically authorized in writing by Flannel for use with such data;
- contains malicious code (including viruses, worms, ransomware, trojan horses, spyware, keystroke loggers, or other harmful or disabling software); or
- infringes any patent, trademark, copyright, trade secret, or other proprietary right of any third party.
3. PROHIBITED CONDUCT
You shall not use the Services to engage in, or to facilitate, the following conduct:
- Unsolicited Communications — sending spam, unsolicited bulk email, "robocalls," or other communications in violation of the CAN-SPAM Act, the Telephone Consumer Protection Act, GDPR, the UK Privacy and Electronic Communications Regulations, Canada’s Anti-Spam Legislation, or any other applicable anti-spam, marketing, or telecommunications law;
- Fraud and Deception — engaging in phishing, pretexting, identity theft, fraudulent transactions, deepfakes used for deception, impersonation of any person or entity, or making false or misleading claims about Flannel, the Services, or any third party;
- Surveillance and Tracking — surveilling or tracking individuals without lawful authority, including conducting covert recording, stalking, doxxing, or non-consensual location tracking;
- Unauthorized Data Practices — scraping, harvesting, or otherwise extracting personal data, including facial images or biometric data, without lawful authority;
- Election and Political Manipulation — generating or disseminating content designed to deceive voters, undermine democratic processes, or impersonate political figures;
- Harassment and Abuse — harassing, threatening, intimidating, or doxxing any person, or facilitating organized harassment campaigns;
- Critical Infrastructure Attacks — using the Services to plan, execute, or facilitate attacks on critical infrastructure (including financial, energy, healthcare, water, transportation, telecommunications, or government systems); or
- Other Illegal Activity — engaging in or facilitating any activity that is illegal in the jurisdiction in which you or the affected person is located, including human trafficking, illegal drug or weapons sales, money laundering, or sanctions violations.
4. SECURITY AND INTEGRITY OF THE SERVICES
You shall not, and shall not permit any third party to:
- attempt to gain unauthorized access to the Services or any related systems, networks, accounts, or data (including by exploiting vulnerabilities, bypassing authentication, or circumventing security measures);
- probe, scan, or test the vulnerability of the Services or any related system or network, except in accordance with Flannel’s published responsible-disclosure or bug-bounty policy;
- interfere with or disrupt the integrity, availability, or performance of the Services or any related system or network, including by launching denial-of-service attacks, flooding requests, or transmitting excessive traffic;
- introduce malicious code, scripts, or content into the Services;
- reverse engineer, decompile, disassemble, or otherwise attempt to derive source code, algorithms, or trade secrets of the Services, except as expressly permitted by applicable law notwithstanding this restriction;
- use bots, scrapers, crawlers, or automated means to access the Services in a manner that exceeds reasonable use, violates rate limits, or imposes an undue load;
- use the Services to develop, train, or improve a product or service that competes with Flannel, or to copy any features, functions, designs, or workflows of the Services; or
- share, sell, transfer, or otherwise misuse account credentials.
5. AI FEATURES AND OUTPUTS
Where the Services include features that use artificial intelligence or machine learning ("AI Features"), you shall not use AI Features or any outputs generated by them ("Outputs") to:
- generate or distribute disinformation, fraudulent content, deepfakes, or content that falsely represents real persons, events, or facts;
- automate decisions that have a legal or similarly significant effect on individuals (such as employment, credit, insurance, education, immigration, housing, criminal justice, or access to essential services) without appropriate human review, transparency, and compliance with applicable laws;
- provide regulated professional advice (such as medical, legal, or financial advice) directly to end users in a manner that fails to make clear the limitations of AI Outputs, fails to include appropriate human oversight, or fails to comply with applicable professional, licensing, or regulatory requirements;
- generate non-consensual intimate imagery, sexualized content involving minors, or content that promotes self-harm, suicide, eating disorders, or violence;
- circumvent or attempt to circumvent any safety measures, content filters, rate limits, or use-case restrictions implemented in or by the AI Features; or
- claim that an Output was authored by a human when it was not, or otherwise misattribute the source of an Output, in any context where doing so would mislead a reasonable person.
You are responsible for evaluating the accuracy and suitability of Outputs before relying upon or distributing them, and for ensuring that your use of AI Features complies with applicable laws (including laws governing automated decision-making, generative AI disclosures, and content moderation).
6. HIGH-RISK AND RESTRICTED USES
Unless Flannel has agreed in writing in advance that the Services are suitable for such uses, you shall not use the Services in any application where failure or inaccuracy could result in death, personal injury, environmental damage, or property damage, including:
- the operation or control of nuclear, chemical, or biological facilities, weapons systems, or military targeting;
- flight control, air traffic control, or other aviation safety systems;
- life-support equipment, surgical applications, or other medical devices regulated by the U.S. Food and Drug Administration or comparable regulators;
- mass transit, autonomous vehicles, or other transportation safety systems; or
- any other system whose failure would foreseeably lead to catastrophic loss of life, environmental harm, or destruction of property.
7. REPORTING VIOLATIONS
If you become aware of any actual or suspected violation of this AUP, you may report it to Flannel by emailing abuse@getflannel.ai. To report copyright infringement, please follow our designated DMCA procedure, available upon request at legal@getflannel.ai. To report a suspected security vulnerability, please follow our Responsible Disclosure Policy.
8. ENFORCEMENT
Flannel may investigate any actual or suspected violation of this AUP. If we determine, in our reasonable discretion, that a violation has occurred or that immediate action is necessary to protect the Services, our customers, or third parties, we may take any action we consider appropriate, including:
- issuing a warning;
- requiring removal or remediation of offending content or conduct;
- suspending or restricting access to the Services in whole or in part;
- terminating accounts or the Agreement in accordance with its terms;
- preserving and disclosing information to law enforcement, regulators, or affected third parties as permitted by law; and
- seeking any other remedy available under applicable law or the Agreement.
Where commercially reasonable and not prohibited by law or legitimate security or operational considerations, Flannel will attempt to contact the affected customer before taking enforcement action and will provide an opportunity to cure. Flannel is not, however, obligated to monitor use of the Services and is not liable for any violation of this AUP by a User or any third party.
9. UPDATES TO THIS POLICY
Flannel may update this AUP from time to time by posting the updated AUP and updating the "Effective Date" above. Where the update materially expands the categories of prohibited use, we will provide reasonable advance notice. Continued use of the Services after the effective date of the updated AUP constitutes acceptance of the updated AUP.
